Does Every Estate Go Through Surrogate’s Court?
No, not every estate in New York goes through Surrogate’s Court. Assets held in a trust, for instance, can avoid this often lengthy and complicated process. Additionally, should a person die without a will, their estate will be “administrated” and not probated. However, if someone passes away and only leaves behind a will, it must be filed in the Surrogate’s Court and approved for probate.
